FOR CLIENTS who come to us seeking compensation following a road
accident here in Spain, it can come as a shock to discover that the
amount of compensation that they will receive is fixed by law. Royal
Decree 8 of 2004 for Civil Liability and Insurance of Motor Vehicles
sets out a fixed scale of compensation, known as a “baremo”.

I live in the UK and am selling my Spanish house at a small loss. I
will not have any Capital Gains Tax to pay as I bought it for €220,000
and I am selling it for €210,000. The purchaser’s lawyer advises me
that a retention of €6,300 must be made to pay my Capital Gains Tax. I
have explained to him that there is no Gain at all but he insists on
making the retention.

WE SOMETIMES have the sad job of informing a new client that the adviser
that they believed was a qualified professional who previously acted
for them when they bought a house or rented business premises in fact
had no qualifications or professional training and has left them in the
lurch.

WE WOULD like to explain in plain language what steps to take if you become involved in a car accident in Spain. Officially the first thing to do it is to check in what way people have
become involved in the accident: drivers; car occupants; and
pedestrians. You should call the Emergency Services number 112 if
someone has been injured.

I WAS divorced at a court in Spain in 2007. In the Court Order it was
stated that my now ex-husband must pay me €400 per month. At that time
my husband was working and earning a decent salary. Last month I was
contacted by him and he told me that his income is now significantly
lower and he told me that he will not pay me the maintenance, in fact he
has not paid me this month and told me that he will not pay me any
more. Is he entitled to do that? What I can do?
